Website Design Plus Website Design Terms of Service

This Website Design Agreement (“Agreement”) is being made between “You", "Client” and Website Design Plus, LLC (“We”, “Us”, or "Designer"). Website Design Plus, LLC may also be referred to as “Party” or together as the “Parties”.
Scope of Service
- Design 1.1 We will provide custom website design services using the WordPress framework.
1.2 The design will encompass up to 7 pages, including blog capabilities.
1.3 We will utilize stock photo resources, if needed, to enhance the visual appeal of the website.
1.4 The website design will incorporate responsive design principles, ensuring optimal viewing experiences across various devices, with a focus on mobile-friendliness.
1.5 We will implement search engine visibility best practices, addressing elements that may not be visible to site visitors but are crucial for search engine optimization.
1.6 Industry keyword research and content editing will be undertaken to position the website favorably for online discoverability.
- Maintenance and Training: 2.1 Following the website's publication, We will provide 2 weeks of free maintenance or updates to address any unforeseen issues or necessary adjustments.
2.2 Additionally, clients will receive 1-hour on-screen training on how to edit and manage their website, empowering them to make basic updates independently.
- Revisions: 3.1 Clients are entitled to 3 rounds of revisions during the website concept phase, allowing for adjustments to the overall design direction.
3.2 Similarly, clients can request 3 rounds of revisions during the website build phase, focusing on refining specific elements and functionalities.
- Exclusions: 4.1 The following are explicitly excluded from the scope of this service:
- Search engine page ranking guarantee.
- Third-party plugin fees, hosting fees, domain name fees, or SSL certificates.
- Maintenance for the site after the first two weeks post-publication. Website maintenance through Website Design Plus is a separate agreement.
Required From Client
- Hosting account administrative access and domain name DNS access
- Proprietary content and images such as logos, employee profile pictures, facility images, or website content
- Administrative-level access to existing website files (if any)
- 50% non-refundable deposit to begin work
Updating the Scope of Service
To update the scope of the Services, You will have to let Us know in written form what You would like to change or do differently. If the new Services are going to require unexpected time or work for Us, then both Parties will have to agree in writing to an updated cost for the Services.
Fee & Payment
Possible third-party fees will be listed in the estimate totals. The amount due before service can begin is a 50% non-refundable deposit. The amount due after final website approval is the remaining 50%. Final payment is due before the website is published to your preferred hosting account. Payments can be made with cash, check, debit or credit card.
The expected timeline for the complete project is 3 to 4 weeks but is not guaranteed. This will depend on how quickly You respond to communication as well as the number of revision requests. Every effort will be made on our part to get the website built as fast as possible without compromising quality.
Communication & Approvals
To decrease possible miscommunication, one designated person from Your team will give the revision requests or approvals on the design concept and functioning website. Any changes need to be identified using our website review tool link to be provided. If needed, parties can have verbal conversations for clarification on the written revision requests.
We retain the copyright on the website design until final payment is made. After the final payment is made then You are the copyright owner. We retain the right to use the website design in any promotional material such as our work portfolio, advertising, or promotions.
After the functioning website has been approved by you then the final payment is due. After the final payment has been received then we will move the website to your preferred hosting provider and make the site live on your domain name and hosting account.
You will have two weeks of maintenance included with the service. Maintenance includes text or image changes that may arise but does not include website redesign. Any maintenance after the two weeks is a separate service with its own terms of service.
The final delivered website will be updated with the most recently available plugins and base frameworks. However, with the fast rate of improvements in the industry, such as browser, plugin, and framework updates, your site will eventually need to be maintained. We will not be held responsible for any issues that may arise on your site after the first two weeks of maintenance.
During the website development, we will host the website on our server. After Client approves the website, we will move the website to your preferred hosting account. The hosting account will be under the Client's name and they are responsible for hosting fees and keeping their account in good standing. If you would like us to host the website, that is a separate service with its own terms of service.
Your proprietary information (login names, passwords, trade secrets, know-how, or, any other confidential information that is not publicly available) will be held in confidence and never sold or traded to third parties.
You are ultimately responsible for the content on your website. We will do quality assurance reviews to catch misspellings, typos, and/or errors but it is up to Client to proofread the final content. We are not responsible for any damages such as lost profits, lost savings, incidental damages, consequential damages, or special damages.
We recommend obtaining an SSL certificate through your hosting provider. In addition, we follow best practices for building websites securely. Website Design Plus is not an internet security firm and cannot guarantee your site against outside threats, such as hackers or bad bots. We recommend inquiring with your hosting provider for any additional website security needs.
Acceptance of Terms
Client will pay for the services rendered by Designer for the Scope of Service as agreed upon. By signing below, Client agrees they have read, understood, and are considered legally bonded to these terms.
